What's the difference between an appeal and an Administrative Review?

An Administrative Review asks the Home Office to check its own decision for a case-working error. An appeal takes the decision to an independent tribunal. Which is available depends on the type of application refused.

What is Judicial Review?

Judicial Review challenges a decision on the basis that it was reached unlawfully, rather than re-arguing the facts. It's generally used where no appeal or Administrative Review is available, or those routes have been exhausted.

How long do I have to challenge a refusal?

Time limits are strict and vary depending on the route being used, so it's important to get advice as soon as you receive a refusal.

Will challenging a refusal affect my ability to stay in the UK while it's considered?

This depends on the type of challenge and your circumstances. We advise on your position at the outset, not after the challenge is already underway.

Can every refusal be challenged?
